BRASILIA – THE minister Ricardo Lewandowski, do Federal Supreme Court (STF), suspended the order of the Ministry of Education (MEC) that forbade universities and federal institutes to demand the passport of the vaccine against covid-19 when returning to in-person activities. The decision was taken on an injunction, in response to an action filed in the Court by the PSB.

Lewandowski argued that the measure taken by the MEC contradicts scientific evidence and strategic analyzes in health by discouraging immunization. “The Federal Supreme Court has, throughout its history, acted in favor of the full realization of the rights to health, education and university autonomy, not appearing possible to compromise even one millimeter with regard to the defense of such fundamental precepts, under the the penalty of incurring an unacceptable civilizatory setback”, wrote the minister.

The order of the MEC was published in the Official Gazette of the Union (DOU) this Thursday, 30. By determination of the Minister of Education, Milton Ribeiro, universities and institutes should only implement sanitary protocols and comply with the guidelines established by a Council resolution National Education of August this year. Lewandowski, on the other hand, understood that federal educational institutions have the authority to demand proof of vaccination against the coronavirus to “exercise certain rights”.

In addition to the PSB, other parties such as PSOL and Rede Sustentabilidade also announced that they would file suits with the STF to suspend the MEC’s ​​order on universities. In early December, in an injunction by Minister Luís Roberto Barroso, the Supreme Court had already suspended provisions of an ordinance of the Ministry of Labor that prohibited companies from dismissing employees who were not vaccinated against the coronavirus or from requiring proof of vaccination at the time of hire the worker.

Also today, minister Carmen Lúcia gave the Bolsonaro government five days to explain the public consultation opened by the Ministry of Health on the vaccination of children against covid-19. Last week, the minister of ministry, Marcelo Queiroga, said that he must request a medical prescription and the signing of a term of responsibility for parents who want to immunize their children from 5 to 11 years old.
